Terms & Conditions
These Terms & Conditions govern the use of envorixa.com and the services rendered by Envorixa SpA, a real estate crowdfunding platform registered with the Comisión para el Mercado Financiero of Chile.
1. Acceptance
Use of the website implies full and unconditional acceptance of these terms. If you do not agree, please refrain from using the platform.
2. Description of the service
Envorixa provides users with a digital portal to (i) learn about high-rise residential real estate projects located in Chile and (ii) participate in their collective financing, after completing the registration and identity verification (KYC) process.
3. Investment risks
Investments in real estate crowdlending are medium-term, illiquid and involve the risk of total or partial loss of capital. Communicated returns are projected and not guaranteed. Each user acknowledges understanding these risks before investing.
4. User obligations
The user undertakes to provide truthful information, keep it up to date, refrain from using the platform for unlawful activities, respect Envorixa's intellectual property and not share access credentials.
5. Fees
Envorixa charges a single 1.5% success fee on the profits distributed. The full structure and any notarial or registry costs are published in each project sheet before funds are committed.
6. Intellectual property
The website content (texts, trademarks, graphics, code) is owned by Envorixa SpA or its licensors. Total or partial reproduction without prior written authorisation is forbidden.
7. Limitation of liability
Envorixa is not liable for indirect damages, loss of profits or investment decisions made by the user based on public site information. Envorixa's maximum liability is capped at the amount of fees actually charged to the claiming user during the previous 12 months.
8. Governing law and jurisdiction
These terms are governed by Chilean law. Disputes shall be submitted to the Ordinary Courts of Justice with seat in the city of Santiago, without prejudice to the consumer's right to resort to the National Consumer Service (SERNAC).
